General Terms and Conditions

 

PREAMBLE

These general conditions of use and sale (hereinafter “the T&Cs”) apply to the conditions of access and use of the site “www.ecoledelocean.fr” (hereinafter the “Site” ). In particular, the present T&Cs apply to the sale of the products defined below. These Terms & Conditions detail all the obligations of the parties.
The Site is published by the Charles Real (hereinafter “The Seller”).
Consultation of the website by any User and access to the services deployed from the Site is subject to consultation, prior acceptance and full compliance with the present T&Cs.

Article 1 – DEFINITIONS

In these T&Cs, the following words or expressions, when used with an initial in capital letters, have the following meaning and can be used indifferently in the singular or in the plural :

Article 3 – ORDERS

These CGU-CGV apply to any order placed by the User on the website.
The User undertakes to provide accurate and up-to-date information.
The User has the possibility of placing certain orders online, from the Site.
The User must choose the offer that suits them and then click on the order button. Any order constitutes acceptance of the prices, descriptions of the services available for sale as well as these T&Cs.
At any time, the User has the option of identifying and correcting errors made when entering their information. When the User notices an error after the conclusion of the contract, he must contact the Seller (go to the “Contact” section).
By clicking in the check box appearing in front of the words “I certify that I have read the T&Cs and accept their terms”, the User irrevocably commits and his acceptance can no longer be called into question.
In certain cases, including non-payment, incorrect address or other problem on the User’s account, the Seller reserves the right to block the User’s order until the problem is resolved.

Article 4 – PRICE

The Seller reserves the right to modify its T&Cs, its prices at any time and without notice. These changes will have no impact on current orders.
Prices take into account the French and European VAT applicable on the day of the order. Any new tax or any increase in existing rates and taxes will be automatically reflected in the price of the products and services offered.
Any tax, duty, duty or other service to be paid in application of French legislation or that of an importing country or a transit country and any modifications thereof between the date of the order and that of the invoice are on client fee.
If an unforeseeable change in the cost of the materials used occurs during the execution of the contract, this change may be reflected in the selling price of the products and services.

Article 5 – METHOD OF PAYMENT

Payments are made by bank card, VISA card and MASTER CARD card.

The User guarantees to the Seller that he has the authorizations possibly necessary to use the payment method chosen by him, when validating the order form. The Seller reserves the right to suspend all order management and delivery in the event of refusal of authorization for payment by credit card from officially accredited organizations or in the event of non-payment.
The Seller reserves the right in particular to refuse to make a delivery or to honor an order from a User who has not fully or partially paid a previous order or with whom a payment dispute is being administered.

Article 6 – ORDER CONFIRMATION

At the end of the validation of his order, the User receives by electronic mail a proof of payment on which appear :
– the name of the customer,
– the customer code (email address of the User ),
– the reference indicated by the customer,
– the date of purchases,
– the order reference,
– the list of products ordered,
– the type of transmission chosen,
– the payment method chosen,
– the amount of the order.

Article 7 – DELIVERY TERMS AND TIMES

Delivery fees depend of your location.
Delivery times are given for informational and indicative purposes only. Delivery delays cannot give rise to any penalty or compensation, nor justify a cancellation of an order because they do not depend on the will of the Seller.

Article 8 – RETURN OF GOODS

No exchange will be possible.

Article 9 – RESERVATION OF OWNERSHIP

The Seller retains ownership of the goods sold until full payment of the price.

Article 10 – TRANSFER OF OWNERSHIP AND RISKS

The transfer of ownership will only be carried out after full payment of the price by the User.

Article 11 – FORCE MAJEURE

The Seller’s liability cannot be implemented if the non-execution or delay in the execution of one of its obligations described in these CGU-CGV results from a case of force majeurr.
As such, force majeure means any event which could not have been reasonably foreseen at the time of the conclusion of the contract and whose effects cannot be avoided by appropriate measures, thus preventing the execution of his obligation by the debtor at the time of the conclusion of the contract. meaning of article 1218 of the Civil Code.

Article 12 – INTELLECTUAL PROPERTY

No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, these documents nor the elements and contents of the Website.

Article 13 – APPLICABLE LAW

These general conditions are subject to the application of French law, to the exclusion of the provisions of the Vienna Convention. This is the case for substantive rules as well as for formal rules. In the event of a dispute or complaint, the User will contact the Seller as a priority to obtain an amicable solution.
